documentation must be based upon testing and analysis which clearly and convincingly proves that achievement of the required limit is beyond the state-of-the-art for the sander. Such testing and the resultant analysis shall be conducted and reported by a professionally qualified acoustical consultant or acoustical laboratory. Documentation shall be furnished to the procuring activity for consideration of whether or nut increase of the required limit is justified. If the contracting officer grants written permission to exceed the 85 dB(A), the sander shall be labeled "HEARING PROTECTION REQUIRED WITHIN (specify) FEET". The distance specified shall be the distance from the operator's position at which the 85 dB(A) limit is met.
Treatment and painting: The floor sander shall be treated and painted in accordance with the manufacturer's normal method for retail distribution.
Materials: The floor sander shall be fabricated from compatible materials, inherently corrosion resistant, or treated to provide protection against corrosion and deterioration that may be encountered in the applicable operating and storage environments in which the floor sander may be exposed.
Certification of commercial item. The contractor shall certify that the floor sander offered to the Government meets the salient characteristics of this description and that the floor sander conforms to the producer's own drawings, specifications, manufacturer's current floor sander offered by the contractor in the commercial marketplace for at least one year preceding the solicitation. The Government reserves the right to require proof of such conformance prior to first delivery and thereafter as may be otherwise provided for under the provisions of the contract.
Regulatory requirements: The contractor is encouraged to use recovered materials in accordance with Publication 94-580 to the maximum extent practicable. For the purpose of this requirement, recovered materials are those materials which have been collected from solid waste and reprocessed to become a source of raw materials as distinguished from virgin raw materials. The components, pieces, and parts incorporated in the floor sander may be newly fabricated from recovered materials to the maximum extent practicable, provided the floor sander produced meets all requirements of this description. Used, rebuilt, or remanufactured components, parts, and pieces shall not be incorporated in the floor sander.
Packaging and marking: When specified, military packaging shall be required when shipments are to overseas Department of Defense (DOD) consignees. Commercial may be specified for shipment to the DOD consignees within the continental United States and the non-DoD consignees worldwide. When a supplier's normal packaging will satisfy the requirement for military packaging, it may be used.
Military packaging: The floor sander shall be preserved and packed to protect against physical damage and deterioration in a logistic environment characterized by the following:
